Maryland Judgment Reports, LLC [MJR] dynamically collates remotely accessible and publicly available defendant driven state and federal electronic civil court records from disparate courts in a single concise judgment report utilized by attorneys, title companies, and lending institutions within the transactional real estate process.

Accounts

Account Owners agree to provide valid information via their Account and Credit Information [collectively, "Account"], and are exclusively liable for any and all use of the Account. Maryland Judgment Reports, LLC [MJR] is not liable for access or use of the Account caused by disclosure of Account information or judgment report orders to or by a third party. Account Owners agree to indemnify, defend, and hold harmless MJR for damages or losses incurred by the Account Owner due to access or use of the Account, or data contained therein, by a third party, whether authorized or unauthorized by the Account Owner.

When utilizing marylandjudgmentreports.com [the "Site"] on behalf of the Account Owner (i.e., as independent contractor, sub-contractor, employee, etc.) you represent that you have the legal authority to accept these Terms of Service on behalf of the Account Owner, in which case the Account Owner accepts these Terms of Service, and "you" and "your" means the Account Owner. The Terms of Service apply to your activities on behalf of the Account Owner.

The Account Owner and any entity acting on behalf of the Account Owner will hold harmless and indemnify MJR from any suit, claim or action arising from or related to the use of the Site or violation of these Terms of Service, including any liability or expense arising from claims (including claims for negligence), losses, damages, suits, judgments, litigation costs and attorneys’ fees.

If the Account Owner suspects unauthorized use of or access to the Account, the Owner should promptly notify MJR.


Disclaimer | Liability

A judgment report encompasses remotely accessible and publicly available electronic MD Circuit Court civil cases and judgments, Baltimore City District Court civil cases, US Bankruptcy Court cases, and US District Court civil judgments; see limitations noted below:
_Federal Tax Liens (IRS) may not be consistently publicly available and accessible via electronic court records in all MD judiciaries;
_Baltimore City District Court civil judgment/lien data may not be consistently publicly available and accessible via electronic court records;
_Prince George's County Circuit Court civil case data may not be consistently publicly available and accessible via electronic court records;
_Prince George's County Circuit Court civil judgment/lien data may not be consistently publicly available and accessible via electronic court records.

A judgment report does not encompass sealed cases by any court of record, cases protected by state and federal privacy laws, tax sales in MD jurisdictions, archived and non-remotely accessible publicly available cases, or criminal cases. The name reflected in a judgment report is not definitive identification for the name ordered: the Account Owner is responsible for the correlation of the name ordered and the name reflected in a judgment report.

marylandjudgmentreports.com [the "Site"] is not the official judiciary site for state and federal courts within Maryland. Maryland Judgment Reports, LLC [MJR] makes no representation regarding the results that may be obtained from the use of the reports; fitness for a particular purpose; or that the Site or reports will meet user requirements. Use of the Site and reports is at the Account Owner's sole risk: any and all liability arising out of use of the Site and reports remains with the Account Owner and entities acting on behalf of the Account Owner.

MJR dynamically collates remotely accessible and publicly available defendant driven state and federal electronic court records. The accuracy and completeness of remotely accessible publicly available state and federal electronic court records is incumbent upon the Maryland and US courts. Maryland and US judiciaries' remotely accessible publicly available state and federal electronic court records may not contain full case information due to legal constraints under Maryland Rules 16-1001 through 16-1011, state and federal privacy laws, or due to complexities of conversion of case records to electronic protocols. Maryland and US judiciaries' remotely accessible publicly available state and federal electronic court records may be restricted in the scope of data accessibility, accuracy, history, or timeliness, and may delete, redact, restrict, or suspend personally identifying information within a case.

Accordingly, MJR is not liable for any issue or loss arising from reliance upon either the accuracy or completeness of remotely accessible publicly available state and federal electronic court records within a judgment report under contract, tort, strict liability, breach of warranty, negligence or other legal theory with respect to the Site, the service, or the report, or for any lost profits or special, indirect, incidental, punitive, or consequential damages of any kind including third party damages.

MJR reserves the right to revise the Terms Of Service or to impose additional stipulations on the use of the Site. Notice of revisions ["TOS v."] or stipulations will be posted on the Site: continuing to access the Site subsequent to the posting of notice of revisions or stipulations indicates the Account owner's acceptance of the Terms Of Service, as amended. MJR also reserves the right to amend or terminate the Site, or any service or subset thereof. Access to the Site, and any and all information or data [collectively, "Data"] ordered or received, in any format or medium, may not be utilized in any manner that violates state or federal laws or regulations, or is inconsistent with the Terms Of Service.

A judgment report is deemed current and comprehensive based on remotely accessible publicly available state and federal electronic court records as of the date and time a judgment report order is submitted. Typical one hour delivery time during a MJR business day is an average time based on quantitative order, search algorithms, report compilation, and email delivery. A MJR business day is defined as Monday through Friday, 9:00 am to 4:00 pm, excluding: state and federal holidays, local, state, federal judiciary closures, suspensions, or service outages, and temporary closing due to inclement weather.


Fair Credit Reporting Act

Maryland Judgment Reports, LLC [MJR] is not a "consumer reporting agency" per the Fair Credit Reporting Act ("FCRA"), 15 U.S.C. § 1681 et seq., as amended. A judgment report is not a "consumer report" as defined by the FCRA.

Account Owners and entities acting on behalf of an Account Owner agree to indemnify, defend, and hold harmless MJR and its officers, directors, members, agents, employees, partners, affiliates, licensors, and data providers from and against any third party claims, demands, expenses (including attorneys' fees) or liabilities of any nature arising from the Account Owner or entities acting on behalf of an Account Owner utilization or dissemination of judgment reports in violation of the FCRA.


Intellectual Property

Maryland Judgment Reports, MJR, MJR Gavel and Sound Block, "Current. Comprehensive. Don't Settle With Less.", "On the go for your business." and other descriptive, promotional, and identifying marks which may or may not be designated on the Site by a “™” “®” “SM” or other similar designation, are registered, pending or unregistered trademarks or service marks of Maryland Judgment Reports, LLC. Graphics, logos, page headers, button icons, scripts and service names are protected under applicable trademark and trade dress law. Maryland Judgment Reports, LLC trademarks, service marks, and trade dress may not be used in connection with any product or service that is not authorized by Maryland Judgment Reports, LLC in writing. Trademarks not owned by Maryland Judgment Reports, LLC that may appear on the Site are the property of the respective trademark owner.

The Site or any portion of the Site may not be reproduced, duplicated, copied, sold, resold, or exploited in any manner for instructional, demonstrative, or commercial purpose without the express, prior written consent of Maryland Judgment Reports, LLC. It is expressly prohibited to utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) without the express, prior written consent of Maryland Judgment Reports, LLC. It is expressly prohibited to use any meta tags or other “hidden text” utilizing Maryland Judgment Reports, LLC trademarks or service marks without the express, prior written consent of Maryland Judgment Reports, LLC. It is expressly prohibited to reverse engineer, decompile, disassemble or otherwise attempt to derive the source code, techniques, processes, algorithms, know-how or other information [collectively, "Reverse Engineering"] from the binary code portions of marylandjudgmentreports.com or permit or induce the foregoing.


Payment

Payment of fees for a judgment report order may only be made with a valid credit card (Credit Information) at the time the order is submitted. If an Account Owner's Credit Information is insufficient, erroneous, or fraudulent, Maryland Judgment Reports, LLC [MJR] may suspend the Account or terminate the use of Site services, at the discretion of MJR.

Fees are invoiced to the Credit Information provided by an Account Owner (including, but not limited to independent contractors, sub-contractors, employees, etc., on behalf of the Account Owner). Fees are applicable for submitted judgment report orders whether or not the judgment report reflects judicial case data, inaccurate or incomplete judicial case data, or no judicial case data. Credit Information is not retained by the Site server or database.


Privacy

Maryland Judgment Reports, LLC [MJR] requires Personally Identifiable Information (i.e., name, company, address, phone, email address, Credit Information) to deliver judgment report services. Credit Information is incorporated within secure payment processing and is not retained by MJR.

MJR does not intend to disclose Personally Identifiable Information unless mandated for: (a) fulfillment of products or services in performance of business, professional or technical support functions; (b) resolution of violation of the MJR Terms of Service, rights of MJR, or the rights of a third party; (c) in cooperation with judicial process as may be required by law.

In the event of a business merger, acquisition, or sale of all or any assets, Personally Identifiable Information may be included. The transitioned Personally Identifiable Information may be subject to the resulting merging, acquiring, or purchaser's Terms Of Service Privacy Policy unless otherwise noted.

MJR reserves the right to collect Non-Personally Identifiable Information (i.e., Operating System, Internet Service Provider, browser, Internet Protocol address) for web traffic analytics. Session and tracking cookies may be utilized to facilitate the use of the Site.
